Wildfires and Property Damage

Fire Season in Colorado was brutal in 2020. Our state saw the three largest wildfires in its history – Cameron Peak, East Troublesome, and Pine Gulch – along with several additional fires of various sizes. The property damage has been harrowing.

469 structures were destroyed by the Cameron Peak fire alone. East Troublesome, while smaller in size, destroyed even more, with more than 300 homes and up to 200 other structures consumed during its most violent expansion. The Pine Gulch fire consumed 598 structures.

Structures destroyed by these fires include primary residences, vacation homes, commercial buildings, and private retreats. Rebuilding will take months, if not years – and that’s assuming insurance companies do what they are supposed to do and provide property owners with the resources they need to clean up, rebuild, and move forward.

Insurance Bad Faith

You pay your insurance premiums under the assumption that, should you need to utilize insurance, it will be there for you to access. This is a reasonable assumption. This is the agreement, both tacit and in writing, between insurance companies and their policyholders. This is not, however, how things always play out.

When you file a fire damage claim, you should be able to rest assured that your needs will be taken care of. Unlike flood damage, fire damage is included in almost all homeowners insurance policies, meaning damage from fire should be covered in full. Again, however, this is not always the case.

Insurance companies are for-profit corporations. Some of these profits come at the expense of policyholders who are cheated out of fair settlements through delays, misfilings, inappropriate denials, and similarly questionable tactics.
